The Place Loyalty Terms

By opting or participating in The Place Loyalty you are entering into a binding agreement with The Place Restaurant with respect to the use of The Place Loyalty Program. You agree to The Place Loyalty Terms and all terms incorporated herein by reference.

The Place Privacy Statement. Pursuant to the loyalty terms, The Place will use your data as it is set out in our privacy policy, which forms an integral part of these terms. It sets out the right you have in respect to the use of your personal information

To participate. To opt-in on The Place Loyalty, you must have downloaded our app form the App or Play store, created an account and signed-in to The Place Loyalty app. Subsequently, you will be asked to opt-in to The Place Loyalty by accepting these Loyalty terms.

Participating Restaurants. After a pilot trial in one of our locations, you can use The Place Loyalty app at any of our locations listed on https://www.theplace.com.ng/

Earning Rewards. To earn rewards on The Place Loyalty is easy; once you have accepted our terms and conditions and account is created, you top-up your loyalty wallet with us and pay for meals in any of our participating stores. Anytime you pay from your main loyalty wallet on the
app in any of our stores, you earn a reward into your reward wallet which is redeemable at any of the stores. You can top-up your wallet using the wallet feature and adding any amount you want.

Routinely or as deemed fit by The Place, users can also earn interest rewards on the total balance in their main wallet.

Redeeming rewards. As you accrue rewards, you can redeem the rewards to make purchase at any time. All you have to do, is type the total amount you want to pay and select which wallet you are making payment from, either your main wallet or rewards wallet and a QR code will pop-up to scan at the store

Gift cards. Another exciting feature of The Place Loyalty app is the Gift card feature. You can buy gift card from your main wallet and send to your loved ones. You can also claim gift cards that has been sent to you and redeem it at any of the store

Point Expiry. Each reward earned has an expiry date as defined by The Place. Rewards will be in your rewards wallet until you redeem it or it expires whichever comes first. If The Place terminates The Place Loyalty, any unused reward balance in your wallet will expire and be
annulled. Upon termination of your The Place Loyalty account for any reason (including, but not limited to, whether you choose to close your account or The Place Loyalty terminates your account for a breach of The Place Loyalty Terms and Conditions), all rewards that you have
accumulated will immediately expire.

Raffles. During specific seasons, as defined by The Place, The Place Loyalty will run a raffle. To participate, you indicate by selecting you have accepted the Terms and conditions of the Raffle herein by reference.
o Once you opt-in for the raffle, eligible transactions on The Place Loyalty App will be kept
o Each eligible transaction will carry a unique ID
o The more eligible transactions you make, the more chances you have to win
o At the end of the season, The Place will conduct a DRAW and select a winner
o The winner will be contacted for a gift prize

Third party Apps. Rewards cannot be earned or redeemed via any other The Place app or third-party delivery service, app or website

No rights on refunds. The Place Loyalty app considered and placed many steps in confirming the amount before topping up your wallet. Hence, The Place will not be responsible, if and when user top-up more money than intended. The Place will not process any refund and user will have to expend through the features of The Place Loyalty app including – Scan & Pay, Gift cards etc.

Compliance with The Place Loyalty. The Place loyalty may take any action it considers appropriate including removing rewards, freezing money in your wallet, suspending or outrightly deleting you’re the Place Loyalty account if and when
o The Place detects suspicious activity in the account
o The Place believes you have abused the loyalty program and or have dealings that are not in accordance with the Loyalty terms
o The Place believes you don’t use it for domestic or private use only
o May have provided us with untrue, half, incorrect or misleading information
o If you have broken any of its terms of use

In the occasion, The Place terminates your loyalty account for any of the above reason, you will lose all earned and interest reward and may forfeit the right to earn and redeem in the future

Changes to The Place Loyalty. The Place loyalty application may change from time to time. You understand and consent that The Place loyalty with or without notice may, with its sole discretion change, modify, update, cancel, discontinue The Place Loyalty fully or in part including any features, benefits, rewards, points, criteria, privacy policy, redemption policy, percentage discount earned, interest income reward, or any aspect of the loyalty at any time, although the changes may affect your rewards in your account at the time

In no event shall The Place loyalty application be liable for any indirect, special, incidental or consequential damages arising out of any use of the information contained herein and/or in relation with the loyalty application process, our services are evolving over time we can change or close the application at any time without any notice, at our sole discretion.

Updates to The Place Loyalty terms and conditions. The Place loyalty application may from time-to-time revise, modify or update The Place Loyalty terms and reserves the right to make such changes. If The Place Loyalty makes significant changes to The Place Loyalty terms, we
will notify you by any reasonable means, such as informing you by posting the new terms in The Loyalty App. The changes will become effective immediately upon posting the revisions and you are solely responsible for being in compliance with these Rewards Terms at all times. If you do not agree to any changed terms, then you must immediately stop using The Place Loyalty app immediately.

Closing your The Place Loyalty account. You are able to discontinue use or close your The Place Loyalty account by deleting the entire app
Events beyond our control. The Place has no responsibility for The Place Loyalty’s failure to perform any of its obligations under these Loyalty terms caused or related to any event beyond

The Place reasonable control. In such events, The Place obligation will be suspended and The Place may but not required to use reasonable endeavors to find a solution by which its obligations under these Loyalty Terms may be performed despite the event

Responsibility of Loss or Damage.
o The Place Loyalty does not make any representation that The Place Loyalty will be precise, infallible, uninterrupted or error-free or that defects will be corrected immediately. You assume total responsibility related to your use of The Place Loyalty
o The Place Loyalty shall not be liable for any direct or indirect profit or loss of business, data, property, incidental or consequential losses or damages of any kind as it relates to the use of The Place Loyalty. The Place Loyalty reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.

Applicable law. This Agreement shall in all respects be governed by and construed and enforced in accordance with Nigerian Laws, including all matters of construction, validity and performance.
